One of the most unpredictable components of divorce mediation was the cost.
Mediated agreements should not be influenced by limiting hours, just to control costs. Acceptable agreements in divorce mediation do not happen in one session. Rarely can they be achieved in two or three sessions. A long lasting, well thought agreement that addresses Property, Support and Custody issues can many times take ten to twenty sessions to resolve every issue important to the clients. Unlimited Fixed Cost mediation means that as long as the participants keep working in good faith and towards solving problems and finding solutions, for a set period of time, usually 2, 6, or 12 months - as many joint sessions, individual sessions, telephone calls, and e-mail correspondences as it takes to come to an agreement, I will continue to work with the clients - all for one fixed fee.

Some clients feel they have worked through and agree on most of the issues between them but still need a little help overcoming a few minor topics and wish for a mediator to memorialize their agreement in writing. These couples may not need as many sessions as a couple that is just starting the divorce or are intrenched in significant conflicts. For them a short, well-defined mediation process is all they require. The session are generally very short, anywhere from 60-90 minutes and the discussions are specific and move rather quickly. Most clients are able to come to final agreement within 4 - 5 sessions. The focus is on finalizing the fine points and getting their agreement to paper. There is a up-front fee at the beginning of the mediation, a small nominal fee for each session, and a final fee upon the delivery of the written agreement to the clients.
